Terms and Conditions
1. Scope
These Terms and Conditions apply to all photography and videography services provided by Flurin Giebel.
By booking a service, the client agrees to these terms and conditions.
2. Booking and Confirmation
A booking is considered confirmed once the client accepts the offer, signs an agreement, or provides written confirmation.
Project details, deliverables, timelines, fees, and usage rights will be defined in the individual project agreement or quotation.
3. Payment Terms
Unless otherwise agreed in writing:
A deposit may be required to secure the booking date.
The remaining balance is due according to the agreed payment schedule.
Final images or deliverables may be withheld until full payment has been received.
Invoices are payable within the stated payment period.
4. Cancellation and Rescheduling
If a client cancels or postpones a booking, cancellation fees may apply depending on the timing and preparation already completed.
If a shoot cannot take place due to weather, safety concerns, or circumstances outside of reasonable control, the project may be rescheduled.
5. Delivery of Images and Videos
The agreed deliverables will be provided within the timeframe stated in the project agreement.
The photographer selects and edits the final delivered images according to their artistic style and professional judgment.
RAW files and unedited material are not included unless specifically agreed upon.
6. Usage Rights and Copyright
All photographs, videos, and creative works remain the intellectual property of Flurin Giebel unless otherwise agreed in writing.
The client receives only the usage rights specified in the project agreement.
Additional usage, commercial applications, resale, or transfer of rights require prior written approval.
7. Client Responsibilities
The client is responsible for providing accurate project information, necessary permissions, access, locations, and required participants.
Delays caused by missing information or preparation may affect delivery timelines.
8. Portfolio and Promotion
Unless otherwise agreed in writing, the photographer reserves the right to use completed work for portfolio purposes, website, social media, exhibitions, and promotional materials.
Confidential projects can be excluded upon prior agreement.
9. Prints and Online Shop
All Fine Art Prints are produced according to the specifications stated in the product description.
Due to the nature of limited edition and made-to-order products, returns or exchanges may not be accepted unless the product arrives damaged or defective.
10. Liability
The photographer is not liable for delays or failures caused by circumstances outside reasonable control.
The photographer takes reasonable care to deliver professional services but cannot guarantee specific results affected by external factors.
11. Applicable Law
These Terms and Conditions are governed by Swiss law.
Any disputes shall be handled according to the applicable legal jurisdiction in Switzerland.
